Prabowo Team vs Jokowi Team Fighting to Guard Election Dispute in MK

Top lawyers are supporting the two teams, but it is still too early to predict the final outcome of the Constitutional Court’s decision.

The feud between the candidate pair 02 Prabowo Subianto-Sandiaga Uno and the candidate pair 01 Joko Widodo-Ma’ruf Amin regarding alleged fraud in the 2019 Presidential Election led to a lawsuit in the Constitutional Court (MK). The two sides prepared a team of top lawyers to handle this case. To what extent will the 'war of stars' from these two camps determine their chances at the Court?

Prabowo-Sandi’s National Winning Team (BPN) Media Sector Chairman Hashim Djojohadikusumo said Bambang Widjojanto will lead the BPN legal team. The former head of the Corruption Eradication Commission (KPK) is also assisted by several experienced legal experts. “His team is quite competent in the field of law,” Hashim said on Friday (5/24).

Imanputra Siddin and Rikrik Rizkiyana were initially said to be part of the team. But then Bambang confirmed that there were seven other people who are members of the Prabowo-Sandi legal team. They are Denny Indrayana, Teuku Nasrullah, Iskandar Sonhadji, Dorel Almir, Luthfi Yazid, Iwan Satriawan, and Zulfadli.

Bambang Widjojanto aka BW is not a foreign figure in handling political disputes. As a lawyer, BW won the case of West Waringin City Regional Head Election (Pilkada) dispute in Central Kalimantan in 2010. At the time, the candidate pair of Ujang Iskandar-Bambang Purwanto was determined as the winner of the election after BW sued the Constitutional Court.

Ujang and Bambang were previously defeated by Sugianto Sabran-Eko Sumatno. This case even brought BW as a suspect of alleged false testimony. As a result, he had to be inactive from his position at the KPK at that time.

The next person in legal team 02 is Denny Indrayana. He previously served as the Deputy Minister of Law and Human Rights during the presidency of Susilo Bambang Yudhoyono. Denny is also a Professor of Constitutional Law at the University of Gadjah Mada (UGM) and has published a book entitled ‘Strategies to Win Election Disputes at the Constitutional Court’.

Iskandar Sonhadji’s name was circulated as the KPK chief candidate in 2007. Meanwhile, Teuku Nasrullah was in the spotlight when he became the attorney of former Indonesian House of Representatives (DPR) Member Angelina Sondakh for the Hambalang Sport Center corruption case a few years ago.

Last year, Dorel Amir had dealt with the Constitutional Court in a lawsuit against Article 169 letter n and Article 227 letter i of the Election Law No. 7/2017. The lawsuit was aimed at limiting the term of office of the president and vice president to only two periods. Lutfi Yazid is a lawyer graduating from the University of Warwick and has a law firm called Jakarta International Law Office.

Iwan Satriawan is a lecturer at the Faculty of Law of the University of Muhammadiyah Yogyakarta (UMY). His name had appeared in the media as the lawyer of Dwi Estiningsih, who was reported to the police because she mentioned five national heroes in the new rupiah notes as infidels on social media.

Zulfadli is a lawyer graduating from the University of Indonesia (UI) and had a career as a Deputy Managing Partner at Yusril Ihza Mahendra’s law office called Ihza & Ihza in 2001-2002. His specialty is in the field of capital markets, litigation, mergers, and acquisitions.

Prabowo’s Team Submits 51 Evidence

The team has submitted 51 evidence to the Constitutional Court Registrar Muhidin. However, Bambang said there is still a possibility that the number of evidence would increase. The evidence submitted to the court is also considered a report on the existence of structured, systematic and massive election fraud. The Elections Supervisory Agency (Bawaslu) previously rejected the report as it was deemed lack of evidence.

“We also encourage the Constitutional Court not to become a numerical court of calculator,” Bambang said, even though he did not mention about the BPN legal team’s moves in this lawsuit.
